A call for employment law tort reform
November 15, 2010

As a business owner I take pride in providing a valuable service, providing a livelihood and positive work environment for my employees. However there are more risks in being an employer these days now more than ever before given the increasingly complex set of laws and requirements put on employers. Employers are often viewed as "rich targets" by opportunistic plaintiff's attorneys.  There are too many attorneys and not enough valid cases so many look to invent cases where none exist. They know that business owners often need to make a cost/benefit decision regarding the time, effort, risk and expenses of defending frivolous lawsuits vs. just settling to remove the obstacle, burden, distraction & ongoing legal expenses that defending such a lawsuit creates. With time as their only expense one attorney once said to me "even if we're wrong, we don't lose." With the current state of our legal system, this amounts to institutionalized extortion. We need tort reform!
